2. CONTENTS PROVIDED VIA FRS

FRS data Data provided NL - Contents [if provided by the NPO]
1 Status Yes - Application published: Patent application published at NPO Register before EPO grant (concerns only EP applications for which translated claims have been filed at the Netherlands Patent Office).
- Request for EP validation received: EP patent granted (B1, B2 or B3), but the national validation procedure is ongoing (basically it is about the translations)
- Patent surrendered: Patent surrendered/ renounced due to a request of the client. Surrender/ Renouncement has a retro-active effect to the B1 granting date. Annual fees could have been paid before the request of surrender/ renouncement was filed. Example no. EP1237494.
- Patent revoked: Patent revoked due to a request of the client or due to the revocation of the European patent. Revocation has a retro-active effect to the B1 granting date. Annual fees could have been paid before the request was filed or the decision was made. ‘Revocation Date’ is associated with both ‘Patent Not In Force’ and ‘Patent Revoked’ (i.e. ‘Invalidation Date’) in Federated Register and thus when revocation date is set both Invalidation Date and Not in force Date will be filled. Example no. EP2310453. ‘Renewal fees last paid’ is unrelated with the revocation of the patent. This field may be available if there is already an annual fee paid for that case. ‘Record last updated’ is unrelated with the revocation of the patent. This field will always be available in Federated Register.
- Patent lapsed: Patent lapsed due to non-payment of an annuity fee. Example no. EP2017066.
- Patent expired: Patent expired after 20 years. Example no. EP2242984.
- Patent validated: The national validation procedure for the patent is successfully finished, i.e. the patent is considered as valid in the Netherlands. Example no. EP2257502. If the first annual fee due after the grant of the EP patent has not been paid yet, the ‘Renewal fees last paid’ field will be empty.
- Patent not validated: The national validation procedure for the patent is unsuccessfully finished, i.e. the patent is not considered as valid in the Netherlands. Example no. EP1254544.
-Nullity: Patent annulled due to a court decision. Example no. EP1356750.
2 Application No. Yes In the Federated Register the application number starts with the prefix EP and does not include the check digit but the Dutch National Register does.
